Gentlemen,
In reply to your letter of the 5th. instant,
I am directed to inform you that the Government is not willing to adopt the amendments to Section 12 of the Harbour of Refuge Ordinance, 1909, proposed in the 12th. paragraph of your letter.
The words "having a frontage on Reclamation Street" were inserted advisedly in the Ordinance, following the precedent of the Praya Reclamation Ordinance, 1889, and the ruling of the Full Court thereon, the Government being of opinion that the right (if any) of a liarine Lot holder to access to the sea accrues in respect of Marine frontage only.
With regard to the alteration in the level
of Reclamation Street, your clients are in the same position as
all other Crown Lessees in the Colony holding lots abutting on
streets the levels of which have been altered and the Government
sees no reason to discriminate in favour of your clients.
It is requested that each of your clients
who is a frontager on Reclamation Street should deliver detailed particulars of his claim under the Ordinance as indicated in the Crown Solicitor's letter to you of the 7th. ultimo with as
little delay as possible.
